The major task of judicial power is to settle conflicts and disputes arising in public and government relations, restore violated rights and punish those who broke the law.

The judicial power in the Republic of Kazakhstan is only owned by courts represented by regular judges, and also jurymen engaged to criminal proceedings in cases and under the procedure stipulated by the law.Justice in the Republic of Kazakhstan is only executed by court. No other bodies and individuals do not have a right to perform the authorities of a judge or functions of judicial power. 

The judicial system of the Republic of Kazakhstan consists of the Supreme Court of the Republic of Kazakhstan, local and other courts established pursuant to the Constitution of the Republic of Kazakhstan and the constitutional law.   

The Supreme Court of the Republic of Kazakhstan is a senior judicial authority for civil, criminal and other proceedings under jurisdiction of local and other courts and performs the functions of cassation instance in relation to the proceedings and provides clarifications on the matters of litigation practice through adoption of regulatory statutes.

The Supreme Court of the Republic of Kazakhstan consists of a chairman and judges. Judicial panels along with specialized panels are established in the Supreme Court. Scientific Advisory Board, International Council and printing authority are established under the Supreme Court of the Republic of Kazakhstan.  Academy of Justice operates under the Supreme Court of the Republic of Kazakhstan.

Under the rules of court of the first instance, the Supreme Court of the Republic of Kazakhstan reviews and settles administrative cases appealing decisions and actions/inactions of the Central Elections Commission as well as decisions and actions/inactions of the Central Referendum Commission.  

Local courts include:

  • regional courts and courts equated to them (municipal court of the capital, municipal courts of cities of the republican significance);

  • district courts and courts equated to them (municipal court, interdistrict court).

Other courts, including specialized courts can be established in the Republic of Kazakhstan (military, finance, economic, administrative,juvenile and others).

Specialized courts are established by the President of the Republic of Kazakhstan and bear the status of regional or district courts.
