In accordance with paragraph 3 of Article 10 of the Constitution of the Republic of Kazakhstan and Article 3 of the Law of the Republic of Kazakhstan "On Citizenship of the Republic of Kazakhstan," a citizen of the Republic of Kazakhstan is not recognized as a citizen of another country. However, it is not uncommon for citizens of the Republic of Kazakhstan to acquire the citizenship of a foreign country without having withdrawn from the citizenship of the Republic of Kazakhstan, and thus they have illegal dual citizenship. The main motive for obtaining a second citizenship is not just the desire for free movement, but also obtaining certain material benefits (for example, pension calculation, a second child's birth allowance, etc.).

If a citizen has obtained foreign citizenship without leaving the citizenship of the Republic of Kazakhstan, he/she is obliged to inform about it within 30 calendar days and hand over a passport and/or identity card of the Republic of Kazakhstan to the internal affairs bodies or foreign institutions of the Republic of Kazakhstan. The fact of Kazakh citizenship renunciation is registered in relation to this category of persons.

The Kazakh citizenship won`t be provided to an applicant if he/she is a citizen of another state. In order to become a citizen of the Republic of Kazakhstan, an applicant should renounce foreign citizenship and hand over his/her foreign passport to an authorized body of a country of former citizenship.

Many citizens neglect the established rules and, using various methods, obtain or retain the citizenship of a foreign state together with the Kazakh one. However, the internal affairs bodies carry out checks, and in case of detection of dual citizenship, they register the Republic of Kazakhstan citizenship renunciation in relation to such individuals. If a citizen still continues to use identity documents after the Republic of Kazakhstan citizenship renunciation, he/she will be brought to administrative responsibility in the amount of 100 MCI according to paragraph 1 Article 496 of the Code of the Republic of Kazakhstan "On Administrative Offenses".
