As soon as the turn of receipt comes, you will need to apply to the akimat and submit the necessary documents for registration of the right of temporary compensatory use (rent) on the allocated land plot.
– Registration and receipt of certificates for temporary compensatory (long-term, short-term) land use (lease)
Then it is necessary to write an appeal to establish the boundaries of the land plot and get an identification document for the land plot.
– Submission of an electronic application for obtaining the technical passport of real estate objects
It is important to note that you have to pay for the land reclamation work and the production of certificates.
After six months from the date of issue of the land use certificate, it is necessary to surrender the dwelling, i.e. to sign the act of putting the individual dwelling house into operation.
– Registration and receipt of acts on the right of private ownership of the land plot
Only in this case the land plot can be provided as private property.
If, however, the house is not built within six months, it is necessary to apply to the akimat and extend the term of temporary rent up to one year. If the land plot is not used for its intended purpose within two years, i.e. there will be no construction or operation of individual housing, the state has the right to withdraw it (Article 92 of the Land Code). At the same time, it will be necessary to compensate the state for the damage under Article 93 of the Land Code, if there were no obstacles to force majeure.
Thus, getting a land plot from the state, you can become a full-fledged owner of the plot only when you build and "comission" a house, until then it is in temporary use – rent.
In order to obtain private ownership of a land plot, which was previously provided on the right of temporary compensatory land use (lease), it is necessary to provide:
- Application for the provision of a land plot for individual housing construction on the basis of the right of private ownership.
- Identity document, original and copy.
- Act of acceptance of the constructed individual house on the land plot.
- Identification document for the land plot.
From the moment of submission of documents, the decision of the akimat on granting the right of private ownership of the land plot shall be made within seven working days. Then it is necessary to register the rights to the land plot.
– State registration of rights (encumbrances) to real estate
