Provision of state-owned land plots that are not provided for land use on the basis of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production, is carried out on the basis of a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production, in the manner and under the conditions established by the article 43-1 of the Land Code of the Republic of Kazakhstan (hereinafter: the Code).

Individuals included into the register of people from whom land plots were forcibly withdrawn, as well as individuals specified in part 5 of Clause 19 of Article 43-1 of the Code are not entitled to participate in tenders for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production.

How to participate in a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production?

Arrangement and management of a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production is performed by local executive bodies of districts, cities of regional significance.    

To arrange a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production, a local executive body of a district, city of regional significance performs the following:

1. publishes a notice on execution of a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production in printed publications distributed on the territory of the corresponding administrative-territorial unit, as well as on the website of a local executive body;
2. sends notifications about a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production to local executive bodies of districts, cities of regional significance within a relevant region, as well as to a central authorized body for publishing on its website.

To ensure availability of information on holding a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production and in accordance with subclause 2) of part 1 of Clause 4 of Article 43-1 of the Code,  local executive bodies of districts, cities of regional significance place a notice on their websites, as well as special information stands of government agencies in places available to the population, and immediately sends it to akims of cities of district significance, villages, townships, rural districts for publishing on their websites and specialized information stands in places available to the population.

A notice should contain the following:

1. date, time and venue of a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production, as well as date and place of applications submission;
2. land plot characteristics (location, area, composition of land, quality characteristics of soils, ball-bonitet, water availability, agricultural specialization of the region).

Local executive body of a district, city of regional significance starts accepting applications for participation in a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production upon the expiry of thirty calendar days from the date of first publication of a notice on arranging a tender of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production in printed publications distributed on the territory of the corresponding administrative-territorial unit, and on the website of a local executive body, and in the case of a repeated tender – upon the expiry of fifteen calendar days.

Acceptance and registration of applications for participation in a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production is carried out within fifteen working days from the date of the start of accepting applications, and in case of a repeated tender - within ten working days.

An application for participation in a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production is submitted in paper or via e-Gov Portal in accordance with the legislation of the Republic of Kazakhstan with mandatory assignment of a registration number and issuance of a notice to an applicant.

An application for participation in a tender for granting of the right of temporary use of land at a charge (lease) for running a peasant or farm enterprise, agricultural production submitted via e-Gov Portal is sent to a local executive body of a district, city of regional significance on a day of summarizing the results of a tender in accordance with the order determined by a central authorized body.   

The last day of a tender for granting of the right of temporary use of land at a charge (lease) is the day when results are summarized.
