Conditions required to get a service
3. According to the procedure established by Clause 1 of Part 4 of Article 3 of the Administrative Procedural Code, one of the specified categories of appeals should be chosen when submitting an appeal:
"Appeals to government agencies and quasi-public sector entities", "Appeals in criminal cases", "Appeals in civil cases", "Appeals in cases of administrative offenses".
For the category "Appeals to government agencies and quasi-public sector entities":
- Pursuant to Article 76 of the Administrative Procedural Code, term for consideration of a request/statement//proposal/feedback/appeal is 15 working days from the date of request receipt, unless otherwise provided by the laws of the Republic of Kazakhstan.
- The specified term may be extended for a reasonable period, but for no more than up to 2 months due to the need to establish actual circumstances relevant for proper consideration, and an applicant is notified about it within three working days from the date of term extension.
- Pursuant to the Article 91 of the Administrative Procedural Code, the term for consideration of a complaint is 20 working days from the date of its receipt.
For the category "Appeals in criminal cases":
- Pursuant to part 2 of Article 105 of the Criminal Procedure Code, complaints against actions (inactions) and decisions of individuals conducting pre-trial investigation, head of the investigative department, head of the body of inquiry and prosecutor submitted by individuals defending their rights and interests or representing those for others are subject to mandatory consideration within 7 days from the date of receipt.
- Complaints to violation of the law during detention, recognition as a suspect, qualification of the suspect's act, removal from office, unauthorized inspection, search, seizure, temporary restriction on disposal of property, suspension of transactions and other activities with property are subject to consideration within 3 days from the date of receipt.
- A petition for lodging a protest, in case of reclamation of the case from the court pursuant to parts 3 and 4 of Article 486 of the Code, is subject to consideration by the prosecutor in cassation within 30 days from the date of receipt of a case by the prosecutor's office.
For the category "Appeals in civil cases":
- A complaint against the decision on administrative offense case; order on the need to pay a fine are subject to consideration within 10 days from the date of receipt (part 1 of Article 826-3 of the Code).
- A petition for lodging a protest, in case of reclamation of the case from the court in accordance with Article 486 of the Code, is subject to consideration by the prosecutor within 30 working days from the date of receipt of the case to the prosecutor's office.
For the category "Appeals in cases of administrative offenses":
- A petition for lodging a cassation protest is considered within 30 working days from the date of its receipt, and if the case is requested then within 30 working days from the date of receipt of the case by the Prosecutor General's Office.
Registration of appeals received by an authorized body after 06:30 PM will begin at 09:00 AM the next working day.
Appeals to government agencies and quasi-public sector entities
Pursuant to article 76 of the Administrative Procedural Code, term for consideration of a request/statement/proposal/feedback/appeal is 15 working days from the date of request receipt, unless otherwise provided by the laws of the Republic of Kazakhstan.

Acceptance of electronic applications, complaints, messages, suggestions, feedback, requests is intended only for applications, complaints, messages, suggestions, responses, requests defined in accordance with the Administrative Procedural Code of the Republic of Kazakhstan as of June 29, 2020 No. 350-VI.

Appeals in criminal cases
Pursuant to part 1 of Article 100 of the Criminal Procedure Code (hereinafter: Code), decisions and actions of an individual conducting a pre-trial investigation and a prosecutor may be appealed by a proceeding participants, as well as individuals and legal entities, if the procedural actions affect their interests.
Pursuant to part 2 of Article 105 of the Criminal Procedure Code, complaints against actions (inactions) and decisions of individuals conducting pre-trial investigation, head of the investigative department, head of the body of inquiry and prosecutor submitted by individuals defending their rights and interests or representing those for others are subject to mandatory consideration within 7 days from the date of receipt.
Complaints to violation of the law during detention, recognition as a suspect, qualification of the suspect's act, removal from office, unauthorized inspection, search, seizure, temporary restriction on disposal of property, suspension of transactions and other activities with property are subject to consideration within 3 days from the date of receipt.
In exceptional cases, when it is necessary to request additional materials or take other measures to verify complaints, it is allowed to consider complaints up to 15 days with notification of individual who submitted complaints.
Pursuant to part 1 of Article 486 of the Code, a petition for review of enforceable judicial acts may be submitted by convicts, their advocates, including the defenders, who joined in the proceedings after a verdict, decree, their legal representatives, victim (private prosecutor), and their representatives, legal representatives,and other individuals whose interests are affected by judicial acts, and their representatives.
Civil plaintiff, civil defendant, their representatives and legal representatives have the right to appeal the verdict in regard to the civil claim.
A petition for lodging a protest, in case of reclamation of the case from the court pursuant to parts 3 and 4 of Article 486 of the Code, is subject to consideration by the prosecutor in cassation within 30 days from the date of receipt of a case by the prosecutor's office.
The period can be extended depending on the complexity of the case or its large volume, but each time for no more than one month.

Appeals in civil cases
Pursuant to part 1 of Article 435 of the Civil Procedure Code (hereinafter: Code), a petition for disputing judicial acts provided for in part one of Article 434 of the Code, may be submitted by the parties, individuals participating in the case, other persons whose interests are affected by judicial acts, as well as their representatives.
Pursuant to part 2 of Article 435 of the Code, Prosecutor General has the right to lodge protests against judicial acts that have entered into legal force for the petitions of individuals specified in part 1 of this article, in cases provided for in part 2 of Article 54 of the Code.
A petition for lodging a cassation protest is considered within 30 working days from the date of its receipt, and if the case is requested then within 30 working days from the date of receipt of the case by the Prosecutor General's Office.
The terms are calculated based on the procedure provided for in Part 2 of Article 122, Article 123 of the Code.
The term for petition consideration is extended by Prosecutor General or Deputy Prosecutor General. Pursuant to parts 1 and 2 of Article 169 of the Administrative Procedural Code (hereinafter: APC), court decisions and rulings that have entered into legal force may be appealed by an administrative process participants in cassation.
The procedure for cassation appeal and proceedings in the court of cassation instance are determined by the rules of the Civil Procedure Code, unless otherwise established by this article.
Pursuant to part 3 of Article 169 of the APC, Prosecutor General has the right to lodge protests against judicial acts that have entered into legal force for the petitions of individuals specified in part 2 of this article in cases provided for in Article 31 of the APC.
The term for petition consideration is extended by Prosecutor General or Deputy Prosecutor General.

Appeals in cases of administrative offenses
Pursuant to Article 826-1 of the Code of Administrative Offences (hereinafter: the Code), an individual in respect of whom proceedings are being conducted on an administrative offence, victim, his/her representative, legal representatives of an individual, representatives of an individual entrepreneur, a legal entity, a defender may appeal a decision on an administrative offence, as well as an order on the need to pay a fine to a higher authority (official).
A complaint against the decision on administrative offense case; order on the need to pay a fine are subject to consideration within 10 days from the date of receipt (part 1 of Article 826-3 of the Code).
Petitions for the revision of judicial acts that have entered into legal force in cases of administrative offenses Pursuant to part 4 of Article 851 of the Code, an individual brought to administrative responsibility, a victim, their legal representatives, defenders, representatives of legal entities have the right to file a petition for bringing a cassation protest. A petition for lodging a protest, in case of reclamation of the case from the court in accordance with Article 486 of the Code, is subject to consideration by the prosecutor within 30 working days from the date of receipt of the case to the prosecutor's office.
