Judicial power
The primary function of judicial power is to resolve conflicts and disputes arising in public and state life, to restore violated rights, and to hold individuals accountable for violations of the law.
Judicial power in the Republic of Kazakhstan is vested exclusively in the courts, represented by permanent judges and, in cases and in accordance with the procedure prescribed by law, by jurors participating in criminal proceedings.
Justice in the Republic of Kazakhstan is administered exclusively by the courts.
No other bodies or persons have the right to assume the powers of a judge or the functions of judicial authority.
Judicial power is exercised on behalf of the Republic of Kazakhstan and serve to protect the rights, freedoms and legitimate interests of citizens and organizations, and to ensure the implementation of the Constitution, laws, other normative legal acts, and international treaties of the Republic.
Everyone are guaranteed judicial protection against any unlawful decisions and actions of government agencies, organizations, officials, and other persons that infringe upon or restrict the rights, freedoms, and legitimate interests provided for by the Constitution and the laws of the Republic.
No one shall be deprived of the right to have his or her case heard, in full compliance with the requirements of law and justice, by a competent, independent and impartial court.
Judicial power is exercised through civil, criminal and other forms of legal proceedings established by law.
Judicial system
The judicial system of the Republic of Kazakhstan consists of the Supreme Court of the Republic of Kazakhstan, local courts, and other courts established in accordance with the Constitution of the Republic of Kazakhstan and this Constitutional Law.
The establishment of special and extraordinary courts under any designation is not permitted.
Local courts include:
- regional courts and courts equivalent thereto (the city court of the capital of the Republic, and the city courts of cities of republican significance);
- district courts and courts equivalent thereto (city courts and inter-district courts).
Other courts may be established in the Republic of Kazakhstan, including cassation courts and specialized courts (military, financial, economic, administrative, juvenile and others).
Specialized courts are established by the President of the Republic of Kazakhstan with the status of a regional or district court.
Cassation courts are established by the President of the Republic of Kazakhstan with the status of an interregional court.
The Supreme Court of the Republic of Kazakhstan, local courts and other courts have a seal bearing the State Emblem of the Republic of Kazakhstan and their respective names.
The Court of the Astana International Financial Centre has a special status and is not part of the judicial system of the Republic of Kazakhstan.
