Many foreign citizens must make visa to cross the border of the Republic of Kazakhstan and while procedure of visa obtaining one of the most important documents, which the foreigner must submit to consulate – is an invitation from Kazakhstan citizen or organization for arrival to the Republic of Kazakhstan. In this article we will describe where such invitation can be prepared and what document are required for that.
Invitation to foreigners is prepared by Kazakhstan citizen in the bodies of internal affairs or in the Ministry of foreign affairs depending on who invites and with what purpose. For invitation of foreign citizen with business, private purposes or as a tourist Kazakhstan individuals and non- governmental organization address to internal affairs bodies at the place of residence or at the place of organization location.
What documents must be provided to internal affairs bodies for invitation preparation to foreigners?
The inviting party for executing the invitation shall submit to the Ministry of Internal Affairs of the Republic of Kazakhstan at the place of its registration:
1) To execute an invitation to enter the Republic of Kazakhstan on private purposes:
- document of identification (for verification).
- a table filled in in two copies according to the form in accordance with Annex 3 to these Rules..
- a document confirming the payment of the state fee when applying to a State Corporation (in case of payment of the state fee through the payment gateway of the "electronic government" (hereinafter - PSHEP), the provision of this document is not required).
2) To approve the petition of a legal entity or an individual entrepreneur:
- a table filled in in two copies according to the form in accordance with Annex 3 to these Rules.
- a document confirming the payment of the state fee when applying to a State Corporation (in case of payment of the state fee through the PSHEP, the provision of this document is not required.
- a document confirming the authority of the representative.
3) Legal entities and individual entrepreneurs, who for the first time apply for the invitation in the current year shall submit:
- a copy of the certificate of state registration of a legal entity or an individual entrepreneur;
- a copy of the certificate confirming the registration/accreditation of a legal entity in accordance with the applicable law of the IFCA;
- a document confirming the authority of the representative;
- inviting party requesting the invitation of foreign tourists – a copy of the license for tourist operator activity issued by the local executive bodies of the regions, cities of the republican significance, the capital, or an extract from the State Register of Tourist Agents, in accordance with the Law of the Republic of Kazakhstan of June 13, 2001 "On Tourism Activities in the Republic of Kazakhstan";
- inviting party requesting the invitation of the recipient of visas for the purpose of obtaining an education – a copy of the license and (or) an appendix to the license for engaging in educational activities issued by the authorized body of the Republic of Kazakhstan in the field of education in accordance with the Law of the Republic of Kazakhstan of July 27, 2007 "On Education";
- inviting party requesting the invitation of a recipient of visas for treatment, medical examination or consultation – a copy of the license for medical activity issued by the authorized body of the Republic of Kazakhstan in the field of health in accordance with the Code of the Republic of Kazakhstan dated July 7, 2020 "On the health of the people and the health care system".
A petition to enter the Republic of Kazakhstan on private matters is submitted not earlier than one year and not later than five days before the expected date of entry of the recipient of visas to the Republic of Kazakhstan.
A petition or verbal note shall be submitted not earlier than 90 calendar days and not later than five days before the expected date of entry of the recipient of visas into the Republic of Kazakhstan.
Petitions of citizens of the Republic of Kazakhstan for the invitation of relatives and friends from abroad and petitions of host organizations are considered within 5 working days from the date of submission of documents.
If the petitions on invitations on private matters are considered positively, the applicants are given invitations of the established form.
The original of this invitation must be sent to the invited foreigner for presentation to diplomatic missions or consular posts of the Republic of Kazakhstan abroad for the registration of an entry visa. You can see the types of visas in the article.
Depending on the category of visa requested, the following shall be additionally provided:
- for investors - a petition of the authorized body of the Republic of Kazakhstan on investments;
- to issue a multiple entry visa for business travel - a copy of the agreement or contract (with the exception of ethnic Kazakhs, former compatriots and citizens from the list of economically developed, politically and migration stable states, exempted from the need to present an invitation for the issuance of visas;
- to participate in religious activities or to carry out missionary activities - the written consent of the authority of the authorized body that regulates religious activities;
- to visit persons serving a sentence in correctional institutions on the territory of the Republic of Kazakhstan - the written consent of the Committee of Correctional System of the Ministry of Internal Affairs of the Republic of Kazakhstan;
- to adopt citizens of the Republic of Kazakhstan - the written consent of the authorized body of the Republic of Kazakhstan in the field of children safeguarding;
- to conduct labor activity, including for seasonal foreign workers - a certificate issued to the employer for the attraction of foreign labor, or a certificate to a foreign worker for employment, or documents confirming that in accordance with the legislation of the Republic of Kazakhstan or international treaties, the recipient of the visa does not need a permission;
- to complete a training internship or internship – a request from the central executive bodies of the Republic of Kazakhstan or "Astana Hub" for training under the "Astana Hub" programs;
- for humanitarian reasons - a document confirming the accreditation in the Republic of Kazakhstan of the requesting international organization or its representation office, or the official registration of a foreign non-governmental organization (fund) in the country of its location in accordance with the legislation of that country, in the presence of an international treaty, on the provision of humanitarian assistance, ratified by the Republic of Kazakhstan;
- to get education - a petition of the educational institution of the Republic of Kazakhstan or the authorized body of the Republic of Kazakhstan for education;
- to care of close relatives - citizens of the Republic of Kazakhstan, or recipients of visas permanently residing in the territory of the Republic of Kazakhstan and being treated in medical institutions - documents issued by a medical organization located in the Republic of Kazakhstan and confirming the need for constant care, confirming the degree of kinship.
A foreigner may not be allowed entering Kazakhstan in the following cases:
- in order to ensure national security, enforcement of public order and public health;
- if his/her actions are aimed at dismantlement of the statehood;
- if he/she opposes the sovereignty and independence of the Republic of Kazakhstan, calls for violation of the unity and integrity of its territory;
- if he/she incites interethnic, inter-confessional and religious strife;
- if this is necessary to protect the rights and legitimate interests of citizens of the Republic of Kazakhstan and other persons;
- if the national security authorities have information about his/her involvement in extremism or terrorist activities, as well as in case of recognition by the court of his actions of a dangerous recidivisms;”
- if he/she has not executed for a criminal or administrative offense, imposed on him/her during his/her previous stay in the Republic of Kazakhstan;
- if during the previous stay in the Republic of Kazakhstan he/she did not submit a declaration on individual income tax in the case when the submission of such a declaration is provided for by the legislation of the Republic of Kazakhstan;
- if he/she has not submitted a confirmation of the availability of funds necessary for stay and leave the Republic of Kazakhstan, in the manner determined by the Government of the Republic of Kazakhstan, with the exception of ethnic Kazakhs, persons born in or who earlier had citizenship of the Republic of Kazakhstan or the Kazakh Soviet Socialist Republic and members of their families;
- if, when applying for an entry, he/she reported false information about himself/herself or did not submit the necessary documents within the time limit established by the legislation of the Republic of Kazakhstan;
- if he/she has diseases that are a contraindication for entering the Republic of Kazakhstan;
- if he/she has earlier lost the citizenship of the Republic of Kazakhstan on the grounds provided for stipulated in subparagraph 8) of the first part of Article 21 of the Law of the Republic of Kazakhstan of December 20, 1991 “On Citizenship of the Republic of Kazakhstan”;
- if he/she was previously deprived of the citizenship of the Republic of Kazakhstan on the grounds stipulated in Article 20-1 of the Law of the Republic of Kazakhstan of December 20, 1991 “On Citizenship of the Republic of Kazakhstan”.
Immigrants previously expelled from the Republic of Kazakhstan are prohibited from entering the Republic of Kazakhstan within five years from the date of the decision to expel.
