Most residents of apartment buildings do not have information on the list of responsibilities of cooperatives of apartment owners (AOC), which leads to a lack of control over the quality of AOC's duties. In this article we will talk about the responsibilities and structure of the AOC. 

Requirements for the chairmen of the AOC.

In accordance with the order of the Chairman of the Agency of the Republic of Kazakhstan for Construction and Housing and Communal Services dated May 29, 2012, No. 215, the following requirements are set for the nominee of the chairmen of the cooperative owners' council recommended by the housing inspectorate:

  • higher education (or post-university education) in the relevant specialty;
  • work experience in senior positions in the organization for at least five years and (or) experience in the service of condominium facilities for at least two years;
  • knowledge of the current legislation of the Republic of Kazakhstan (Civil Code of the Republic of Kazakhstan of December 27, 1994 Civil Code of the Republic of Kazakhstan (Special Part) of July 1, 1999, the Code of the Republic of Kazakhstan on Administrative Offenses of July 5, 2014, the Labor Code of the Republic of Kazakhstan of November 23, 2015, the Laws "On Housing Relations" of the Republic of Kazakhstan dated April 16, 1997, "On Natural Monopolies and Regulated Markets" of July 9, 1998, "On Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan" of July 16, 2001,the Rules for the maintenance of the common property of the condominium object approved by the Decree of the Government of the Republic of Kazakhstan dated 19 February 2015 No. 108, other normative and technical documents in the sphere of management of the condominium object):
  • to have the skills of prompt acceptance and implementation of managerial decisions, planning work and control, conducting business negotiations, public speaking, analyzing and forecasting the consequences of management decisions, organization of work on interaction with state bodies and suppliers of public services, practical application of normative legal acts, development of organizational and administrative documents, work with official documents, possession of computer and other organizational equipment.

What is the responsibility of AOC?

In accordance with the Standard form of the management agreement of the condominium object approved by the order of the Minister of National Economy of the Republic of Kazakhstan dated March 20, 2015 No. 242, the responsibilities of the management body of the condominium object for managing the condominium object include:

  1. Organize the holding of meetings, written interviews with the owners of the premises (apartments).
  2. Conclude and monitor the execution of contracts with the subject of service activities.
  3. To draw up the minutes of the meeting of the owners of the premises (apartments) and the voting sheets when conducting written interviews.
  4. To inform the new owners of the premises (apartments) in writing about the decisions previously made by the general meeting of the owners of the premises (apartments).
  5. Organize the implementation of decisions of meetings of owners of premises (apartments) quality content of common property and ensure the safety of residence.
  6. Represent the interests of owners of premises (apartments) on the common property of the condominium.
  7. To collect contributions by issuing a receipt for management services, as well as contributions for the maintenance and overhaul of the common property of the condominium facility, the sizes of which are approved by the meeting of owners of the premises (apartments) from the owner, tenants.
  8. Provide for all owners, in all accessible places, the placement on the stands of information about organizations (name, contact numbers, emergency telephone numbers) that carry out maintenance and repair of the premises, as well as common property, as well as organizations - providers of public services.
  9.   10. Ensure that contracts concluded for the fulfillment of the terms of this Agreement are recorded.
  11. To open within fifteen working days from the date of formation for each condominium object a current account in a second-tier bank to which contributions (payments) of owners of premises (apartments) for maintenance and current repair of the common property of this condominium object are transferred.
  12. Open for each condominium object a savings account in a second-tier bank for the accumulation of sums for capital repairs of the common property of this condominium object within fifteen working days from the date of establishment.
  13. Perform functions related to the registration of the condominium object within fifteen working days from the date of formation.
  14. Provide on request of the owners of the condominium object information on the movement of money on the bank account, funds for the maintenance of a residential building (residential building).
  15. Notify the Owner of the forthcoming major overhaul of the common property of the condominium, repair of public spaces in the condominium facility for two months, about disconnecting, testing or otherwise changing the operating mode of utility networks - for two days, except in cases of emergencies.
  16. In the event of termination of the management agreement for the condominium object, transfer the technical (design and estimate documentation, site plan, passports, acceptance certificates and other documents), executive (acts of work performed and services under contracts concluded with service entities, copies of contracts with service entities), and financial (agreement of current and savings accounts with second-tier banks, approved cost estimates for the content of the common condominium object, protocol of the decisions of the general meeting) documentation available to it to the newly elected Management Body of the condominium object under the acceptance certificate.
  17. To fulfill the duties stipulated by the Law of the Republic of Kazakhstan of April 16, 1997 "On Housing Relations" and other laws of the Republic of Kazakhstan in the sphere of housing relations.

According to paragraph 1 of Article 42-1 of the Law of the Republic of Kazakhstan "On Housing Relations" issues related to the management and maintenance of the condominium are considered and decisions on them are taken at meetings of owners of premises (apartments).

What reports should AOC provide? 

In accordance with Article 50-2 of the Law of the Republic of Kazakhstan "On Housing Relations", the costs of maintaining the common property of the condominium should be reflected in the report on the management of the condominium facility, which is presented individually to the owner of the apartment (apartment) in writing or in the form of an electronic document every quarter in the form approved by the authorized body, until the tenth day of the month following the reporting period.

The report on the management of the condominium object should also reflect additional costs not related to the costs of maintaining the common property of the condominium, if any.

The eKSK website is intended not only for KSK employees, but also for residents and for Akimat.

  • Online bulletin board;
  • Possibility of discussing the general house needs;
  • Possibility of paying utility bills online;
  • View reporting of condominium for control information on income and expenses;
  • Filing a complaint or appeal directly to an Akim's office;
  • Subscription to news.

On the website you can send meter readings and pay postUAC. Also on the building website via the “Appeal to condominium” you can contact the Akim's office and condominium of your house. An application will be reviewed within three days. After sending a request, you can track the status through your personal account, wh ere notifications about status changes will arrive.
