People with disabilities is someone who is incapacitated by a chronic illness or injury and as a consequence needs to be socially protected.
Social protection of the people with disabilities in the Republic of Kazakhstan is stipulated by the RK Constitution, the Cod of the Republic of Kazakhstan "Social Code of the Republic of Kazakhstan" and other normative regulatory acts.
People with disabilitie are entitled to:
- Social protection, including habilitation, rehabilitation, integration into society;
- provision of conditions for preschool education and training, education;
- guaranteed volume of free medical care and medical assistance in the system of compulsory social health insurance in accordance with the procedure determined by the legislation of the Republic of Kazakhstan;
- guaranteed volume of special social services;
- vocational training and retraining, rehabilitation and employment;
- providing access to infrastructure facilities, informatization, transport, information, entertainment cultural events, sports competitions and public services;
- exercising their right to vote and be elected;
- housing in accordance with the housing legislation of the Republic of Kazakhstan;
- priority services in government and other organizations, including healthcare, culture, communications, transport, and services.
Social assistance for the people with disabilitie:
- state allowances, compensations and other benefit payments;
- additional social transfers paid by local executive bodies;
- subsidiary welfare benefits paid by the employer and other organizations.
People with disabilitie housing
Local executive bodies:
- register and accommodate disabled who need housing;
- equip dwellings for people with disabilitie or families having the disabled with special means and facilities.
People with disabilitie employment
Local executive bodies ensure employment of the people with disabilitie by:
- fixing up quota of working positions for people with disabilitie at the rate of three per cent from the total number of the work places;
- creating additional employment for people with disabilitie through individual, small and medium business development;
- creating special and social jobs for people with disabilitie employment;
- organizing professional training of the people with disabilitie.
For disabled people of the first and second categories, a reduced working time of no more than thirty-six hours a week is established, an additional paid annual leave of absence of at least six calendar days is granted. Work at night is allowed with the consent of a disabled person and provided that such work is not prohibited for him for health reasons.
Refusal to conclude an employment contract or in promotion, dismissal on the initiative of the employer, transfer of a disabled person to another job without his consent on grounds of disability are not allowed, except for cases when, according to the conclusion of the territorial unit of the authorized body in the field of social protection of the population, the state of his health impedes the performance of professional duties or threatens the health and safety of others.
Providing employment for disabled people
To ensure the employment of disabled people, local executive bodies (akimats) set a quota of jobs for disabled people in the amount of two to four percent of the number of workplaces without taking into account jobs in heavy work, work with harmful, hazardous working conditions in accordance with the legislation of the Republic of Kazakhstan on employment of the population; create additional jobs for disabled people through the development of individual entrepreneurship, small and medium-sized businesses; create special, as well as social workplaces for the employment of disabled persons in accordance with the legislation of the Republic of Kazakhstan; organize vocational training for disabled people.
Legislation guarantees the rights of disabled people in relation to labor relations. It is provided that the refusal to conclude an employment contract or in promotion, dismissal on the initiative of the employer, transfer of a disabled person to another job without his consent on grounds of disability are not allowed, except for cases when, according to the conclusion of the territorial unit of the authorized body in the field of social protection of the population, the state of his health impedes the performance of professional duties or threatens the health and safety of others.
Criteria for invalidity groups establishment
Criterion for first invalidity group establishment is steady full-blown disturbance of organism functions conditioned by diseases, trauma or defects consequences, leading to full-blown restric-tion of one of the following life activity categories or their combination:self-service ability of 3 degree;ability to move of 3 degree;ability to work (work capacity) of the 3 degree; ability to learn the 3 degree;ability to orient oneself of 3 degree;communication ability of 3 degree;ability to control one’s behavior of 3 degree.
Criterion for second invalidity group establishment
Steady full-blown disturbance of organism functions conditioned by diseases, trauma or defects consequences, leading to full-blown restriction of one of the following life activity categories or their combination:self-service ability of 2 degree;ability to move of 2 degree;working ability of 2, 3 degree;ability to train of 2,3 degrees;ability to orient oneself of 2 degree;communication ability of 2 degree;ability to control one’s behavior of 2 degree.
Criterion for third invalidity group establishment
Steady full-blown disturbance of organism functions conditioned by diseases, trauma or defects consequences, leading to full-blown restriction of one of the following life activity categories or their combination: self-service ability of 1 degree;ability to move of 1 degree;working ability of 1 degree;ability to train of 1 degrees;ability to orient oneself of 1degree;communication ability of 1 degree;ability to control one’s behavior of 1 degree.
Employment of people with disabilitie
For people with disabilitie employment the local executive agencies (akimats) establish a quota of work places for invalids from 2 to 4 per cents of total amount of workplaces not taking into account the workplaces with heavy duty, hazardous job in accordance with the Republic of Kazakhstan Law on population employment.
People with disabilitie rights concerning labor relations are guaranteed by legislation. It has been provided by legislation that refuse in labor contract or career development, discharge by employer his transference on other work without his agreement are not allowed except the cases when his health state hinders from performing his professional duties or threatened his health and labor safety of other persons by the decision of territorial executive body of social
Education preferences rendered to people with disabilitie
When entering educational institutions giving trade and higher education children people with disabilitie of the first and second groups are provided by the acceptance quota at the rate 0,5%.
People with disabilitie of higher and trade institutions training by government work or grant are provided by benefits of scholarship.
Types of rehabilitation of the disabled
Medical rehabilitation provides a set of medical services aimed at preserving, partial or complete restoration of impaired and (or) lost functions of the body.
Social rehabilitation of disabled people is aimed at creating conditions for overcoming disabled people's handicaps, restoring their social status, their social and environmental adaptation. It includes teaching disabled people basic social skills of personal hygiene, self-service, movement, communication; providing them with technical support (compensatory) and special means of transportation; provision of special social services for people with disabilities at home, in medical and social institutions (organizations); provision of social services for an individual assistant for disabled people of the first group who have difficulty in moving, a sign language specialist for the disabled by hearing - sixty hours a year; providing legal assistance in accordance with the legislation of the Republic of Kazakhstan; Other types of social rehabilitation in accordance with the individual rehabilitation program (IRP).
Invalids according to IPR are provided with prosthetic-orthopedic assistance, surdo-typhlo-technical means, compulsory hygienic means, wheelchairs, sanatorium treatment and other means of social rehabilitation, on the basis of application of invalids to provide funds and rehabilitation services, at the expense of the state budget in accordance with the legislation of the Republic of Kazakhstan on public procurement.
The system of social services for people with disabilities in need of outside care and assistance represents in the republic a network of medical and social institutions, territorial social service centers and social assistance units at home. The elderly and disabled people living in boarding homes are provided with care, food, social and medical care, social adaptation, labor rehabilitation, and training.
There are 12 territorial centers of social care for the elderly and disabled in the republic, whose functions include rendering social services to these categories of citizens, carrying out medical, social and professional rehabilitation, creating conditions for children with disabilities to absorb educational programs (providing social and pedagogical services), creating favorable moral and psychological climate, informing the serviced persons about their rights, volumes and types of social services.
What category of persons are considered as participants and invalids of GPW?
Military men who served in military units, staffs and departments being part of acting army and fleet of world, civil and Great Patriotic War and also in other warfare on defending of former USSR guerilla and crypto of civil and GPW are considered as participants of War.
Invalids are persons among military men of acting army and fleet, guerilla and crypto of civil and GPW and also workers and employers of such category being invalids from wound, contusion, maim or disease in world, civil or GPW, on battle area, defensive position constructions, naval bases and airdromes and equated on pension insurance to military men.
What documents are necessary for acquisition the status of participant, invalid of Great Patriotic War and persons equated with them
Status of participant, invalid and persons equated with them is determined on the ground of certificates, military cards confirming participation in War, warfare on defending of former USSR disaster control of Chernobyl NPS and other civilian and military objects, invalid certificate, medico legal reports.
Veteran’s card is issued on the grounds of these documents by bodies under the Ministry of Defense of the Republic of Kazakhstan and disabled war veteran’s card by bodies of social protection and population of RK. Record is stamped in pensioners’ card of persons equated with them on preferences and guarantees.
