Ethnic Kazakhs who have independently entered the territory of the Republic of Kazakhstan may submit an application for the assignment of the kandas Status to the State Corporation. The applicant must submit the following documents:
- application;
- autobiography (in any form);
- copies of identification documents of the applicant and his family members (if any), with a notarized translation into Kazakh or Russian (birth certificates, passport, stateless person certificate or other official documents of special authorities of the country of origin of ethnic Kazakhs);
- copies of documents establishing compliance of the applicant with the conditions provided for by subparagraph 3) of paragraph 2 of the Rules for the assignment or extension of kandas status.
The assignment of the kandas Status is carried out by local executive bodies of regions, Astana, Almaty and Shymkent cities.
The local executive body within four working days from the date of registration of the application makes a decision to ethnic Kazakhs and their family members about awarding the kandas status, issues an kandas's certificate or reasonably refuses to confer the kandas status.
If an ethnic Kazakh has an individual identification number, the total period for consideration of documents and assignment of kandas status is carried out within three working days.
After the decision, the local executive body sends information on the results of assigning the kandas Status and the kandas Certificate to the State Corporation. After receiving the results, the State Corporation issues the kandas Certificate, or is notified of the denial of the kandas Status.
The local executive body refuses to assign the kandas status when:
1) inconsistency of the applicant and his family members (if any) with subparagraph 2) of paragraph 2 of the Rules for assigning or renewing kandas status;
2) non-compliance of the applicant and his family members (if any) with subparagraph 3) of paragraph 2 of the Rules;
3) establishment of the fact of unreliability of the submitted documents.
Ethnic Kazakhs living outside the Republic of Kazakhstan submit an application for the assignment of the kandas Status to the foreign institution of the Republic of Kazakhstan.
The application shall be accompanied by the following documents:
- autobiography (in any form);
- copies of identification documents of the applicant and his family members (if any), with a notarized translation into Kazakh or Russian (birth certificates, passport, stateless person certificate or other official documents of special authorities of the country of origin of ethnic Kazakhs);
- copies of documents establishing compliance of the applicant with the conditions provided for by subparagraph 3) of paragraph 2 of the Rules for the assignment or extension of kandas status.
Foreign missions of the Republic of Kazakhstan issue a written notification to the applicant about the registration of his application for obtaining the consent of the local executive body to assign the status of an kandas as incoming correspondence, and send the application and documents to the authorized body on migration issues for making a decision in accordance with Article 20 of the Law.
The authorized body for migration of the population sends the decision of the local executive body on consent to the assignment of kandas status or on refusal with a reasoned justification of its reasons to the foreign establishment of the Republic of Kazakhstan for forwarding to the applicant.
Foreign establishments of the Republic of Kazakhstan, after receiving the consent of the local executive body to assign the status of kandas, within one month, send it to the applicant or notify of the refusal.
The applicant and his family members (if any) who have received the consent of the local executive body to assign the status of an kandas, upon arrival at the place of residence to obtain the status of an kandas, apply to the local executive body or the State Corporation in the form in accordance with Appendix 1 to the Rules, with documents attached specified in the list of documents required for the provision of public services of the public service standard in accordance with Appendix 2 to the Rules.
To provide adaptive and integration services, centers for adaptation and integration of kandas are being created.
Kandas, as well as members of their families, are accommodated free of charge in the Center for temporary residence. The Center creates conditions aimed at speedy adaptation and integration of kandas into society. The order and terms of residence of kandas and their family members in the center of adaptation and integration of kandas, as well as the procedure for providing them with adaptation and integration services are determined by the authorized body on migration issues.
In the absence of official or own housing, kandas can temporarily register in the centers for adaptation and integration of kandas, temporary accommodation centers for a period of not more than one year.
The kandas Status is terminated after he receives the citizenship of the Republic of Kazakhstan.
