The service on bankruptcy of individuals available on eGov.kz portal and eGov Mobile app Printable version
March 3, 2023The public service called "Application of out-of-court bankruptcy procedure" is available on the eGov.kz portal and eGov Mobile app. The service enables submitting requests for application and termination of out-of-court bankruptcy procedure.
Pursuant to the Law of the Republic of Kazakhstan "On Solvency Restoration and Bankruptcy of Citizens of the Republic of Kazakhstan", which came into force on March 3, 2023, only a debtor can submit a request for bankruptcy procedure via eGov.kz portal and eGov Mobile app.
Prior to submitting a request, a debtor should verify the following information:
- debt to banks, microfinance organizations, debt collection agencies should not exceed KZT 5.5 million and delay in payment should be at least 12 months;
- there should be no property on the right of ownership, including property that is in joint ownership;
- a debtor should provide a response from a bank or microfinance organization on refusal to change a contract terms (if there is no response from a bank or microfinance organization available, then a copy of a debtor's request or confirmation of sending a request online);
- if no repayment for a debt has been made for more than 5 years, all the above conditions are not taken into account;
- debtors who have been receiving a targeted social assistance for 6 months can apply for application of bankruptcy procedure without taking into account a repayment delay period;
- verify the registration of a debtor's and spouse's phone number in the Mobile Citizens Database (MCD). To register a mobile number, follow the link my.egov.kz.
"Dear users! There is no point in submitting a request via eGov.kz portal or visit CSC without a complete package of documents, please, first get the required confirmations from second-tier banks. Only after that you can apply for bankruptcy as an individual" said Rostislav Konyashkin, Chairman of the Board, National Information Technologies JSC.
On the eGov.kz portal, the new service can be found on the homepage in "For Citizenry" - "Customs and taxes" - "Economics and Finance". A similar service is available in the eGov Mobile app in the "Special Services" section.
To submit a request for application of out-of-court bankruptcy procedure one needs to:
- verify compliance with the conditions for submitting a request for declaring as bankrupt under out-of-court procedure provided for by the Law of the Republic of Kazakhstan;
- specify a spouse`s IIN if married;
- provide information about financial organizations which issued loans;
- indicate a tax authority and attach copies of documents;
- check the box if obtaining a targeted social assistance;
- check the box if the term for obligations execution is more than 5 years;
- sign a request using a one-time password or a digital signature;
- after submission of a request, a spouse needs to approve it in a personal account.
The service delivery result will appear within 15 working days in personal account as a link to decision. The decision can be viewed on the website of the Ministry of Finance of the Republic of Kazakhstan. The out-of-court bankruptcy procedure will take up to 6 months.
Moreover, the service provides for submitting a request for termination of out-of-court bankruptcy procedure. The procedure also takes up to 6 months from the date of information publication.
The new service was implemented thanks to cooperation between National Information Technologies JSC, Ministry of Digital Development, Innovations and Aerospace Industry of RK and Ministry of Finance of RK.
